Welcome to The Accidental Farmgirl Co. These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, content, features, and related services (collectively, the “Services”).

Throughout these Terms, “The Accidental Farmgirl Co.,” “Accidental Farmgirl,” “we,” “us,” and “our” refer to The Accidental Farmgirl Co.

By accessing our website, creating an account, placing an order, or otherwise using our Services, you agree to these Terms and to any policies referenced within them, including our Privacy Policy, Refund Policy, and Shipping & Returns Policy.

If you do not agree to these Terms, please do not use our Services.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to offer our products and Services to you.

1. Eligibility and Online Store Terms

By using our Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you are the age of majority and have authorized any minor dependents under your supervision to use this website.

You may not use our website, products, or Services for any unlawful or unauthorized purpose. You may not violate any applicable local, state, federal, or international law while using the Services.

You may not transmit viruses, malicious code, or other materials intended to interfere with the operation or security of our website or Services.

We reserve the right to suspend or terminate access to the Services for violations of these Terms.

2. Products and Handcrafted Variations

Many Accidental Farmgirl products are handcrafted or assembled by hand using premium faux florals, greenery, fruit, natural-looking materials, ribbon, baskets, grapevine forms, and other decorative components.

Because of the handcrafted nature of our products and the realistic variation inherent in many of the materials we use, no two pieces will be exactly alike. Minor variations in color, shape, placement, texture, size, floral composition, ribbon, and other details are normal and are not considered defects.

We make every reasonable effort to accurately represent our products through photography, descriptions, dimensions, and other information provided on the website. However, colors and details may appear differently depending on lighting, photography, screen settings, and the natural variation of individual materials.

Finished measurements may vary slightly due to the handmade nature of our products. Customers should review the dimensions and product information provided on each individual product page before purchasing.

3. Product Availability

Certain products may be available in limited quantities, offered seasonally, made to order, or available exclusively online or at Farmgirl’s Front Porch.

We reserve the right to:

  • limit quantities available for purchase;

  • limit sales to particular individuals, households, geographic areas, or jurisdictions;

  • discontinue or modify products at any time;

  • change product descriptions, availability, or pricing without prior notice; and

  • refuse or cancel orders where reasonably necessary.

All product offers are void where prohibited by law.

Availability displayed on the website is subject to change, including if an item sells out before inventory information is updated.

4. Pricing and Payment

All prices are displayed in the currency indicated on the website and are subject to change without notice.

We make reasonable efforts to ensure that prices, promotions, discounts, and product information are accurate. If an error occurs, we reserve the right to correct it and, where permitted by law, cancel or adjust an affected order.

Applicable taxes, shipping charges, duties, or other fees will be displayed or calculated where appropriate during checkout.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information when placing an order.

By submitting payment information, you represent that you are authorized to use the selected payment method.

5. Orders

Submission of an order does not guarantee acceptance. We reserve the right to accept, decline, limit, or cancel an order in our reasonable discretion, including orders that appear fraudulent, contain incorrect information, involve pricing or inventory errors, or appear to be placed for unauthorized resale.

If we cancel or materially change an accepted order, we may attempt to notify you using the email address, telephone number, billing information, or other contact information supplied at checkout.

Because many Accidental Farmgirl pieces are created or prepared specifically for each order, we do not accept order cancellations once an order has been placed, except where otherwise required by law.

If you notice an error in your shipping information or wish to request another change, please contact us as soon as possible. We cannot guarantee that a change can be made once production, fulfillment, or shipment has begun.

6. Processing, Shipping and Delivery

Processing and delivery estimates are provided for convenience and are not guarantees.

Many Accidental Farmgirl pieces are made to order and require processing prior to shipment. Current estimated processing times, shipping information, available shipping methods, and related policies are provided on our Shipping & Returns page and applicable product pages.

Once a package has been transferred to the shipping carrier, delivery timing may be affected by carrier delays, weather, holidays, customs, incorrect delivery information, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

International shipments may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country. Unless otherwise stated, these charges are the responsibility of the recipient.

7. Returns, Refunds and Exchanges

Returns and refunds are governed by our current Refund Policy and Shipping & Returns Policy.

Accidental Farmgirl does not currently offer exchanges or order cancellations.

Eligible products may be returned in accordance with the timeframe, condition requirements, exclusions, and procedures described in our current Refund Policy.

Certain products are final sale, including customized products and garland orders. Additional final-sale exclusions may apply where clearly identified on the product page or within our Refund Policy.

Original shipping charges are nonrefundable unless otherwise required by law, and customers may be responsible for return shipping costs.

Seasonal or other eligible products may be subject to a restocking fee where disclosed in our applicable policies.

Please review our Refund Policy and Shipping & Returns Policy before making your purchase.

Accidental Farmgirl’s current site states that eligible returns must be initiated within 48 hours of receipt and that exchanges and cancellations are not accepted.

8. Product Care and Outdoor Use

Some Accidental Farmgirl products may be suitable for indoor or protected outdoor display. Product-specific care recommendations should always be reviewed before use.

Faux florals and decorative materials may fade, discolor, warp, deteriorate, or otherwise become damaged when exposed to prolonged sunlight, extreme temperatures, water, moisture, severe weather, or other environmental conditions.

Unless expressly stated otherwise, outdoor use does not mean that a product is weatherproof or indestructible.

Customers are responsible for following any care, storage, and display instructions provided on the product page or elsewhere on our website.

We are not responsible for ordinary wear, fading, weather-related damage, improper storage, improper installation, misuse, or failure to follow provided care instructions.

9. Gift Cards

Accidental Farmgirl gift cards are subject to any terms displayed at the time of purchase.

Gift cards may be redeemed for eligible purchases through our online store, subject to availability and applicable law.

Gift cards are not redeemable for cash except where required by law.

Customers are responsible for protecting gift-card codes from unauthorized use. We are not responsible for gift cards that are lost, stolen, shared, or used without authorization, except where required by applicable law.

If separate gift-card terms are displayed on the applicable product page, those terms are incorporated into these Terms by reference.

10. Promotions and Discount Codes

From time to time, we may offer promotional codes, sales, giveaways, gifts with purchase, or other special offers.

Unless otherwise stated:

  • promotions may not be combined;

  • promotional codes have no cash value;

  • offers may be limited by date, product, quantity, or customer;

  • exclusions may apply;

  • promotions may be modified or discontinued where permitted by law; and

  • discounts cannot be retroactively applied to previously completed purchases.

Additional terms disclosed with a particular promotion will apply to that offer.

11. Accounts

Certain features may allow or require you to create a customer account.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring under your account.

You agree to provide accurate information and promptly update your information when necessary.

Please contact us if you believe your account has been accessed without authorization.

12. Intellectual Property

Unless otherwise indicated, the website and its contents are owned by or licensed to The Accidental Farmgirl Co. and are protected by applicable intellectual-property laws.

This includes, without limitation:

  • trademarks and brand names;

  • logos and graphics;

  • product names and collection names;

  • photographs and videos;

  • product descriptions and written copy;

  • floral designs and original creative content to the extent protected by law;

  • website design and visual materials; and

  • other original content appearing on the website.

You may access and use the website for your own personal, noncommercial use.

You may not reproduce, copy, republish, distribute, sell, modify, exploit, scrape, create derivative works from, or commercially use our content without our prior written permission, except as expressly permitted by law.

Nothing in these Terms transfers ownership of any intellectual-property rights to you.

13. Reviews, Photographs and User-Submitted Content

You may have opportunities to submit reviews, comments, photographs, videos, testimonials, social-media content, or other materials (“User Content”).

You retain ownership of any rights you hold in your User Content.

By voluntarily submitting User Content directly to us for publication, tagging Accidental Farmgirl in content intended to feature our products, or expressly giving us permission to share your content, you grant us a nonexclusive, worldwide, royalty-free license to reproduce, display, publish, repost, adapt, and use that User Content in connection with our website, social media, marketing, advertising, and promotion of Accidental Farmgirl.

Where reasonably practicable, we may identify or credit the original creator, but we are not required to do so unless separately agreed.

You represent that:

  • you own or have permission to submit the User Content;

  • its use will not infringe the rights of another person;

  • it does not contain unlawful, misleading, defamatory, obscene, or malicious material; and

  • any statements or reviews reflect your genuine experience.

We reserve the right, but not the obligation, to moderate or remove User Content where appropriate.

14. Third-Party Services and Links

Our Services may integrate with or contain links to third-party websites, applications, payment providers, shipping services, social-media platforms, review services, or other tools.

Third-party services are governed by their own terms and privacy practices.

We are not responsible for the availability, content, accuracy, security, practices, products, or services of third parties that we do not control.

Your use of third-party services is at your own discretion and subject to the terms of the applicable provider.

15. Shopify

Our online store is powered by Shopify.

Shopify provides ecommerce infrastructure and related functionality that helps us operate the online store. Your use of certain Shopify-powered features may also be subject to Shopify’s applicable terms and privacy practices.

Nothing in these Terms makes Shopify responsible for Accidental Farmgirl products, order fulfillment, product representations, customer service, returns, or other obligations belonging to The Accidental Farmgirl Co.

16. Personal Information and Privacy

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

By using the Services, you acknowledge that certain personal information may be processed as necessary to provide the Services, process transactions, fulfill orders, communicate with you, prevent fraud, comply with law, and for other purposes described in our Privacy Policy.

Shopify provides merchants with privacy-management features, but merchants remain responsible for configuring their practices appropriately for applicable privacy laws.

17. Electronic Communications

When you provide your email address or other contact information in connection with an order, inquiry, customer account, or other transaction, we may contact you regarding that transaction or your relationship with us.

Marketing emails or text messages will be sent in accordance with applicable law and your communication preferences.

You may unsubscribe from marketing communications using the unsubscribe method provided in the applicable communication. Transactional or service-related messages may still be sent when necessary.

18. Prohibited Uses

You may not use the website or Services:

  • for any unlawful or fraudulent purpose;

  • to violate the rights of another person or entity;

  • to infringe intellectual-property, privacy, publicity, or other rights;

  • to transmit malware, viruses, or harmful code;

  • to obtain unauthorized access to our systems or another user’s information;

  • to collect, scrape, harvest, or track information through unauthorized automated means;

  • to interfere with the security or operation of the website;

  • to submit false, deceptive, abusive, defamatory, threatening, discriminatory, or unlawful content;

  • to impersonate another person or misrepresent your identity; or

  • for unauthorized commercial exploitation of our website or content.

We reserve the right to restrict or terminate access for prohibited conduct.

19. Errors, Inaccuracies and Omissions

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, dimensions, pricing, promotions, availability, shipping, or other information.

We reserve the right to correct errors, update information, or cancel affected orders where permitted by law.

We are not obligated to update information solely because it appeared on the website at an earlier date, except where required by law.

20. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

Nothing in these Terms excludes or limits warranties, guarantees, remedies, or other consumer rights that cannot lawfully be excluded.

Except for rights that cannot be waived under applicable law, we disclaim warranties to the fullest extent permitted by law, whether express or implied.

21. Limitation of Liability

To the fullest extent permitted by applicable law, The Accidental Farmgirl Co. and its owners, officers, employees, affiliates, contractors, service providers, suppliers, licensors, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to your use of the Services or purchase or use of our products.

Nothing in these Terms limits liability where doing so would be prohibited by law.

Any limitations stated in these Terms will apply only to the maximum extent permitted under applicable law.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Accidental Farmgirl Co., its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable legal expenses arising from:

  • your material violation of these Terms;

  • your unlawful use of the Services;

  • your infringement of another party’s rights; or

  • User Content submitted by you that violates these Terms or applicable law.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.

The remaining provisions will continue in full force and effect.

24. No Waiver

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other right.

Any waiver must be made expressly and will apply only to the particular circumstance for which it was given.

25. Entire Agreement

These Terms, together with any policies, product-specific terms, and other terms incorporated by reference, constitute the agreement between you and The Accidental Farmgirl Co. regarding your use of the Services.

If a product page, promotion, or separate policy contains additional terms applicable to a particular transaction, those additional terms will apply to that transaction.

26. Governing Law

These Terms and your use of the Services will be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to conflict-of-law principles, except to the extent another jurisdiction’s law applies and cannot lawfully be waived.

Subject to applicable consumer-protection law, disputes arising from these Terms or the Services will be brought before a court of competent jurisdiction in Rhode Island unless otherwise required by law.

I intentionally did not add mandatory arbitration or a class-action waiver. Those are substantive legal choices, not generic website language I think we should insert on Jessica’s behalf without counsel.

27. Changes to These Terms

We may revise these Terms from time to time to reflect changes to our Services, business practices, policies, or applicable requirements.

The updated Terms will be posted on this page with a revised “Last Updated” date.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Changes will not retroactively alter rights or obligations where prohibited by law.
